释义	退还定金不需要解除合同，只要债务人履行了债务，收取定金的人应当退还定金。《民法典》第五百八十七条规定：”债务人履行债务的，定金应当抵作价款或者收回。给付定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，无权请求返还定金；收受定金的一方不履行债务或者履行债务不符合约定，致使不能实现合同目的的，应当双倍返还定金。”给予退还定金的一方要求退还定金的，不需要解除合同，只需要履行了合同义务，就可以要求对方当事人退还定金。法律依据《民法典》第五百八十七条
