问题	死亡前签订的协议书有效吗
释义	一方当事人死亡后，协议是否继续有效应视情况而定。对于纯属财产性质的合同（比如买卖和租赁合同），一方当事人死亡的，不应影响合同的效力。但具有人身依附性的合同（如服务合同），一方当事人死亡的，合同效力自然终止。《商品房租赁管理办法》第十二条：房屋租赁期间内，因赠与、析产、继承或者买卖转让房屋的，原房屋租赁合同继续有效。承租人在房屋租赁期间死亡的，与其生前共同居住的人可以按照原租赁合同租赁该房屋。
