法律分析：不发工资构成财产侵权，可以向劳动部门申请劳动仲裁。用人单位拖欠工资的，劳动者可以搜集相关证据(劳动合同、工资发放记录)并采取以下措施：
1、向劳动保障行政部门(劳动监察大队)投诉。
2、向劳动争议仲裁委员会申请劳动仲裁。如：以未按时足额发放工资为由，向劳动争议仲裁委，请求解除劳动关系并支付工资和经济补偿金。若仍想维持劳动关系的，可以只请求支付工资。
法律依据：《中华人民共和国劳动法》 第五十条 工资应当以货币形式按月支付给劳动者本人。不得克扣或者无故拖欠劳动者的工资。
