释义	法律分析: 义务兵，在部队服役期间，是没有回家探亲的假期的，除非是相当特殊的原因。义务兵回家的时候，就是退伍之时。允许回家探亲的，是志愿兵，也就是大家知道的士官，只有士官及以上军衔，每年才会有一个月或者是40天左右的假期！法律依据: 《退伍义务兵安置条例》第七条退伍义务兵回到原征集地三十天内，持退伍证和部队介绍信到县、市、市辖区兵役机关办理预备役登记，然后向退伍军人安置机构报到，凭退伍军人安置机构介绍信办理落户手续。
