释义	法律分析：在互相斗殴的过程中一般不存在正当防为的行为。但是如果一方停止或者被动停止了加害行为，而另一方转化成加害方时，则有可能存在正当防卫行为。互相斗殴，指双方或多方在主观上均具有不法侵害的故意，客观上均实施了不法侵害对方的行为。是互殴各方均有对对方加害的行为，在司法实践中，互殴中不法侵害转化的情形有以下两种： 1.一方已经停止斗殴，向另一方求饶或者逃跑，而另一方仍紧追不舍，继续实施侵害的； 2.在一般性的轻微斗殴中，一方突然使用杀伤性很强的凶器，另一方生命受到严重威胁的。
