释义	法律分析: 专利申请有如下程序: 1、申请。即当事人提交请求书、说明书等文件； 2、初步审核。即专利政部门收到发明专利申请后十八个月内，进行初步审核，符合要求的，即行公布； 3、实质审核。即发明专利申请自申请日起三年内，进行实质审查； 4、核准申请。法律依据:《《中华人民共和国专利法》》第三十九条发明专利申请经实质审查没有发现驳回理由的，由国务院专利行政部门作出授予发明专利权的决定，发给发明专利证书，同时予以登记和公告。发明专利权自公告之日起生效。
