释义	我国有法定的节假日，节假日不上班不能算事假，事假是指劳动者因为个人原因需要在正常工作时间请的假，节假日包含正常休息日和法定节假日，是国家规定的劳动者可以享有的权利。如果劳动者事假期间在法定节假日的，法定节假日的天数不属于事假范围。【本文关联的相关法律依据】《中华人民共和国劳动法》第三十八条用人单位应当保证劳动者每周至少休息一日。第三十九条企业因生产特点不能实行本法第三十六条、第三十八条规定的，经劳动行政部门批准，可以实行其他工作和休息办法。
