释义	法律分析：依据我国现行法律规定可以发生产品责任的产品应具备以下条件： (一)产品存在缺陷。 (二)有损害事实发生。 (三)损害因产品缺陷而造成。以上产品责任的三方面构成要件必须同时具备，产品提供人才能承担产品责任，对于受害方当事人来说，在产品责任诉讼过程中，它必须证明产品存在缺陷，确有损害事故发生，并且，产品缺陷与损害之间存在近因关系，其所受到的损害才能得到赔偿。法律依据：《民法典》第一千二百零二条，因产品存在缺陷造成他人损害的，生产者应当承担侵权责任。
