释义	法律分析：在立案之日起五天内发出传票。法院从收到起诉书到发出传票要经过两个阶段。第一个阶段就是对起诉书的审查，民法院收到起诉状或者口头起诉，经审查，认为符合起诉条件的，应当在七日内立案，并通知当事人；认为不符合起诉条件的，应当在七日内裁定不予受理；原告对裁定不服的，可以提起上诉。第二个阶段就是向被告送达起诉状。法律依据：《中华人民共和国民事诉讼法》第一百零九条人民法院对必须到庭的被告，经两次传票传唤，无正当理由拒不到庭的，可以拘传。
