释义	1、借款的利息不得预先在本金中扣除。2、利息预先在本金中扣除的，应当按照实际借款数额返还借款并计算利息。所以出借人预先扣除利息都是违反国家法律禁止性规定的无效行为。3、支付利息是借款合同履行的重要内容，借款人应当到期返还借款并支付利息。风险提示：民间借贷的利率可以适当高于银行的利率，各地法院可以根据本地区的实际情况具体掌握，但最高不得超过银行同类贷款利率的3倍(包含利率本数)。超出此限度的，超出部分的利息不予保护。法律依据《民法典》第六百七十条
