释义	法律分析：我国的民法典对孩子抚养权作出了规定。通常情况下，不想要孩子的抚养权可以给对方。如果夫妻中的一方没有能力可以抚养孩子，那么可以先和另一方协商变更孩子抚养权，如果另一方不同意变更孩子的抚养权，那么该方可以到管辖区的人民法院提起诉讼，要求法院根据双方的条件对抚养权作出判决。法律依据：《最高人民法院关于适用婚姻家庭编的解释（一）》第五十五条离婚后，父母一方要求变更子女抚养关系的，或者子女要求增加抚养费的，应当另行提起诉讼。
