释义	法律分析：已满16周岁，可以进工厂上班。如果没有达到法律所规定的用工年龄，就到用工单位上班，这个时候用工单位需要面临着处罚，因为这是属于使用童工。我国目前为止有两部法律明确禁止用人单位使用童工。法律依据：《中华人民共和国劳动法》第十五条禁止用人单位招用未满十六周岁的未成年人。《禁止使用童工规定》(国务院令第364号) 第二条国家机关、社会团体、企业事业单位、民办非企业单位或者个体工商户均不得招用不满16周岁的未成年人。
