有离婚协议书还去法院吗
释义
夫妻双方签订书面离婚协议的，应亲自到婚姻登记机关申请离婚登记，也可以到法院诉讼离婚。离婚协议书生效的要件就是依据该离婚协议书办理了离婚证，在没有办理离婚证的情况下，该离婚协议书是不发生法律效力的，任何一方具有权利否认该协议书的效力，然后直接去法院起诉离婚。
【法律依据】
《民法典》第一千零七十六条，夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。
离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。
