释义	法律分析：坐在驾驶座，没有驾照，车没有走，不能认定为无证驾驶的，无证驾驶，是指机动车驾驶人在未获取或持有与所驾车型相对应的合法准驾证明的情况下驾驶该机动车。只是坐坐，不构成无证驾驶的。法律依据：《中华人民共和国道路交通安全法》第九十九条未取得机动车驾驶证、机动车驾驶证被吊销或者机动车驾驶证被暂扣期间驾驶机动车的处二百元以上二千元以下罚款，可以并处十五日以下拘留。
