遗产起诉能要回孙子的抚养权吗?
释义
如果孙子女的父母没有死亡，祖父母是不能够要回孙子女的抚养权的。抚养权是指父母对其子女的一项人身权利，抚养有婚生的抚养与非婚生的抚养之分。抚养关系是长辈和晚辈之间的，并且是长辈对无行为能力人（主要是未成年人）的保护并教养，强调的是教育和保护。
【法律依据】
《民法典》第一千零七十四条
有负担能力的祖父母、外祖父母，对于父母已经死亡或者父母无力抚养的未成年孙子女、外孙子女，有抚养的义务。
有负担能力的孙子女、外孙子女，对于子女已经死亡或者子女无力赡养的祖父母、外祖父母，有赡养的义务。
