释义	法律分析: 遗弃患病婴儿，情节恶劣的，具有扶养义务的人就构成遗弃罪。如果是将婴儿遗弃在荒无人烟的地方，或者一般人无法施救和察觉的郊外，导致婴儿因无人发现而死亡或者重伤的，不应构成遗弃罪，而应构成故意杀人罪或者故意伤害罪。《中华人民共和国刑法》第十四条【故意犯罪】明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
