释义	我国是二审终审制。追诉期限是10年。犯敲诈勒索罪处3年以下有期徒刑、拘役或者管制。数额巨大或者有其他严重情节的处3年以上10年以下有期徒刑。法律依据：《中华人民共和国刑法》第八十七条犯罪经过下列期限不再追诉：1.法定最高刑为不满5年有期徒刑的，经过5年。2.法定最高刑为5年以上不满10年有期徒刑的，经过10年。3.法定最高刑为10年以上有期徒刑的，经过15年。追诉时效4.法定最高刑为无期徒刑、死刑的，经过20年。如果20年后认为必须追诉的，须报请最高人民检察院核准。
