释义	有扶养义务的人，对年老、年幼、患病或者其他没有独立生活能力的人拒绝扶养，情节恶劣的行为，涉嫌刑事犯罪，遗弃罪。发生遗弃情形时，可以先寻求当地自治组织的帮助，进行协调，协商不成的，被遗弃人可以自行或委托他人到法院起诉，要求履行抚养义务。如果情节恶劣，涉嫌犯罪的，可以到法院自诉遗弃罪。法律依据: 《中华人民共和国刑法》第二百六十条虐待家庭成员，情节恶劣的，处二年以下有期徒刑、拘役或者管制。犯前款罪，致使被害人重伤、死亡的，处二年以上七年以下有期徒刑。
