释义	法律分析: 自陷风险首先是指，被害人在危害的结果发生之前已经意识到了存在的风险。以下情形不属于被害人自陷风险：1、如果被害人对风险并不知情，并且无从得知的情况下则不构成自身风险；2、被害人对其风险本身明确或者默认许可；3、被害人对于危害的结果在发生之前持否认态度；4、如果此风险发生的可能性极低，并且通常被人们所忽视也不属于被害人自陷风险。法律依据: 《中华人民共和国刑法》第五条刑罚的轻重，应当与犯罪分子所犯罪行和承担的刑事责任相适应。
