释义	法律分析：可以同时起诉债务人及保证人，人民法院可以将债务人和保证人列为共同被告参加诉讼。连带责任保证的债权人可以将债务人或者保证人作为被告提起诉讼，也可以将债务人和保证人作为共同被告提起诉讼。法律依据：《最高人民法院关于适用〈中华人民共和国民事诉讼法〉的解释》第一百二十五条一般保证的债权人向债务人和保证人一并提起诉讼的，人民法院可以将债务人和保证人列为共同被告参加诉讼。但是，应当在判决书中明确在对债务人财产依法强制执行后仍不能履行债务时，由保证人承担保证责任。
