释义	符合下列条件的，才会构成非法出卖武器装备罪，即主观方面是故意，主体是特殊主体；客观方面是实施了非法将军队的武器装备出卖给他人的行为，客体是军队的武器装备。【法律依据】《中华人民共和国刑法》第四百三十九条非法出卖、转让军队武器装备的，处三年以上十年以下有期徒刑；出卖、转让大量武器装备或者有其他特别严重情节的，处十年以上有期徒刑、无期徒刑或者死刑。第四百四十条违抗命令，遗弃武器装备的，处五年以下有期徒刑或者拘役；遗弃重要或者大量武器装备的，或者有其他严重情节的，处五年以上有期徒刑。
