释义	法律分析：无效。离婚协议的效力，不但要有一般协议的有效要件，还需要具备法定登记机关的相关手续这一特定形式要件，才能产生法律效力。法院一般也不会依据离婚协议的内容来判决双方离婚，但可以依据该份协议结合其它证据来证明夫妻双方的感情问题及家庭财产情况等等。《民法典》第一千零七十六条【协议离婚】夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。
