释义	法律分析：不当得利是指没有法律依据而被确认为他人遭受损失的利益。应当承担返还的义务。比如卖货时多收货款，捡丢失的物据为己有等。获得利益的人称受益人，受损的人称受害人。获得不当得利不是因为受益人对受害人的违法行为；而是因为受害人或者第三人的疏忽、误解或者过错。因此，受益人与受害人形成债务关系，受益人为债务人，受害人为债权人。法律依据：《中华人民共和国民法典》第一百二十二条因他人没有法律根据，取得不当利益，受损失的人有权请求其返还不当利益。
