释义	律师解答：生产(包括配制)、销售假药，涉嫌下列情形之一的，应予立案追诉：(一)含有超标准的有毒有害物质的；(二)不含所标明的有效成份，可能贻误诊治的；(三)所标明的适应症或者功能主治超出规定范围，可能造成贻误诊治的。【法律依据】：《中华人民共和国刑法》第一百四十一条生产、销售假药的，处三年以下有期徒刑或者拘役，并处罚金；对人体健康造成严重危害或者有其他严重情节的，处三年以上十年以下有期徒刑，并处罚金；致人死亡或者有其他特别严重情节的，处十年以上有期徒刑、无期徒刑或者死刑。
