口头赠与怎样才能生效 -法律知识

法律分析：
赠与合同是需要公证的，没有公证的赠与合同需要当事人有实际的所有权转移行为才能使合同生效。但是社会捐助，公益捐助虽然可以口头赠与，但是它们可是有特殊“金刚罩”的“特种赠与”哦。只要当事人进行口头承诺就生效哦，这是为了保护公益事业的原因。
法律依据：
《中华人民共和国民法典》 第六百五十七条 赠与合同定义 赠与合同是赠与人将自己的财产无偿给予受赠人，受赠人表示接受赠与的合同。
第六百五十八条 赠与人任意撤销权及其限制 赠与人在赠与财产的权利转移之前可以撤销赠与。
