释义	法律分析：假冒专利罪数罪并罚的情形：1、行为人既假冒他人专利，又假冒他人注册商标，按两罪处理，实行数罪并罚；2、行为人既假冒他人专利，又生产或销售伪劣商品，按两罪处理，实行数罪并罚。法律依据：《中华人民共和国刑法》第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。第二百一十六条假冒他人专利，情节严重的，处三年以下有期徒刑或者拘役，并处或者单处罚金。
