释义	法律分析：根据最高人民检察院、公安部《关于经济犯罪案件追诉标准的规定》的有关规定，假冒他人专利，涉嫌下列情形之一的，应予追诉：1、违法所得数额在10万元以上的;2、给专利权人造成直接经济损失数额在50万元以上的;3、虽未达到上述数额标准，但因假冒他人专利，受过行政处罚2次以上，又假冒他人专4.造成恶劣影响的。法律依据：《中华人民共和国刑法》第二百一十六条假冒他人专利，情节严重的，处三年以下有期徒刑或者拘役，并处或者单处罚金。
