释义	法律分析: 只要是在因工外出期间发生事故造成职工下落不明的，就应该认定为工伤，其工伤认定不以宣告失踪为要件。因工外出是指职工由于工作需要到本单位以外从事与本职工作有关的工作，包括两种情况：一是到本单位以外但是还在本地范围内，二是到本地区以外或境外。在第一种情况下，可以是受领导指派，也可以是因职责需要自行到本单位以外的情形。在第二种情况下，则必须是受领导指派的情形。法律依据: 《工伤保险条例》第十四条职工因工外出期间，由于工作原因受到伤害或者发生事故下落不明的，应当认定为工伤。
