一、坐出租车不给钱违法吗
1、市民乘坐出租车不给钱，是属于违法行为的。民事违法行为分为违反合同行为和侵权行为两大类，前者指合同当事人没有合法事由不履行或不完全履行合同义务的行为，后者指合同以外的，非法侵犯他人民事权利的行为。市民乘坐出租车的，与出租车公司间成立客运合同关系，市民乘坐出租车后不给钱的，属于不履行合同的行为，所以属于民事违法行为。
2、法律依据：《中华人民共和国民法典》 第一千一百六十五条
行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。
依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
第一千一百六十六条
行为人造成他人民事权益损害，不论行为人有无过错，法律规定应当承担侵权责任的，依照其规定。
第一千一百六十七条
侵权行为危及他人人身、财产安全的，被侵权人有权请求侵权人承担停止侵害、排除妨碍、消除危险等侵权责任。
二、坐出租车出车祸怎么办
1、保护现场不要破坏，打电话给交警和保险公司到场处理。需报上车牌号、车主姓名、保险单号、驾驶员姓名、对方车牌号等信息，取得报案号码；
2、保险公司派人到现场拍照取证；
3、双方将事故车辆共同开到交警快速理赔中心，填写快速理赔确认书，交验行驶证、驾驶证；
4、交警受理调查，确认事故责任归属。
