释义	报捕和批捕当然有区别，而且这两者有着很大的差别，报捕是指公安机关将案件移送检察院报请逮捕,此时当事人是否会被批准逮捕还处于未知状态，而批捕则是检察机关经审核案件，认为案件事实清楚、证据确实充分,依法符合批捕标准，进而做出的批捕决定，此时案件的状态是确定的、明确的，就是被逮捕。【法律依据】《刑事诉讼法》第八十七条，公安机关要求逮捕犯罪嫌疑人的时候，应当写出提请批准逮捕书，连铜案卷材料、证据，一并移送同级人民检察院审查批准。必要的时候，人民检察院可以派人参加公安机关对于重大案件的讨论。
