释义	法律分析：定罪免处指的是行为人的行为在法律上已经构成犯罪，并且应当负刑事责任，但是根据行为人所实施行为的社会危害性程度及行为人实施行为时的主观恶性、人身危险性，和其他量刑情节综合考虑，认为对行为人不需要判处刑罚的情形。法律依据：《中华人民共和国刑法》第三十七条对于犯罪情节轻微不需要判处刑罚的，可以免予刑事处罚，但是可以根据案件的不同情况，予以训诫或者责令具结悔过、赔礼道歉、赔偿损失，或者由主管部门予以行政处罚或者行政处分。
