释义	法律分析：对病情严重不能控制的，可以解除合同，不过是否有精神病，需有关机关作出确认。法律依据：《劳动部关于实行劳动合同制度若干问题的通知》第十条在固定工制度向劳动合同制度转变过程中，对已患有精神病但病情得到控制的职工，用人单位应当安排适当工作，签订劳动合同；对病情严重不能控制的，应当送医院治疗。医疗终结后，按照国家有关规定办理退休或退职手续。第十一条用人单位对新招用的职工，在试用期内发现并经有关机构确认有精神病的，可以解除劳动合同。
