法律分析：公务员不适用劳动法，当然也不受劳动法保护，公务员受《中华人民共和国公务员法》保护。
法律依据：《中华人民共和国劳动法》 第二条 在中华人民共和国境内的企业、个体经济组织（以下统称用人单位）和与之形成劳动关系的劳动者，适用本法。
国家机关、事业组织、社会团体和与之建立劳动合同关系的劳动者，依照本法执行。
《中华人民共和国公务员法》 第一条 为了规范公务员的管理，保障公务员的合法权益，加强对公务员的监督，建设高素质的公务员队伍，促进勤政廉政，提高工作效能，根据宪法，制定本法。
