释义	无事实婚姻一说。但我国我国刑法追究体制仍然承认“事实婚姻”。重婚罪属于“被害人有证据证明的轻微刑事案件”，也就是可选择的自诉案件，并非完全意义上的自诉案件。被害人的地位更接近于公诉案件的控告人而非真正意义上的自诉人，案件随时可能转化为公诉案件。因此，被害人无权自由选择被告（是重婚者还是相婚者），不能自行和解，不能自行撤诉。法律依据：《中华人民共和国刑法》第二百五十八条有配偶而重婚的，或者明知他人有配偶而与之结婚的，处二年以下有期徒刑或者拘役。
