开发商必须具备哪些条件,才可以预售商品房商品房预售应当符合下列条件:1、已交付全部土地使用权出让金,取得土地使用权证书;2、持有建设工程规划许可证;3、除付清地价款外,投入开发建筑的资金已达工程预算总投资额的25%,并经注册会计师验资;4、房地产开发商和金融机构已签订预售款监管协议;5、土地使用权未抵押或者已解除抵押关系。符合上列条件的,经主管机关核准后,发给《房地产预售许可证》。
