释义	法律分析：犯罪主体年龄为十四周岁。以暴力、胁迫或者其他手段强奸妇女的，处三年以上十年以下有期徒刑。奸淫不满十四周岁的幼女的，以强奸论，从重处罚。收买被拐卖的妇女，强行与其发生性关系的，依照刑法第二百三十六条的规定的强奸罪定罪处罚。根据《刑法》第236条的规定，有下列两种情形之一的，都应当以强奸罪立案追究： 1、以暴力、胁迫或者其他手段强奸妇女的； 2、奸淫不满14周岁幼女的。强奸罪是行为犯，只要行为人实施了强奸妇女或者奸淫幼女的行为，不论是否达到奸淫的目的，都应当立案追究。
