释义	【法律意见】刑事诉讼法第二百三十二条第二审人民法院受理上诉、抗诉案件，应当在二个月以内审结。把上诉状交给一审法官以后，一审法院再转到中级法院还要经过一段时间，这一段时间是不计算在二审诉讼时效内的。人民法院审理对判决的上诉案件，应当在第二审立案之日起三个月内审结。有特殊情况需要延长的，由本院院长批准。举个例子，比如9月1日立案，10月16日开庭，那12月1日前会下判决书。10月16日到12月1日之前法院都可能下判决书。
