问题	如何惩罚协助恶意逃避债务
释义	恶意逃避债务虽然是一种违法行为，但我国目前的刑事法律并未明确规定其为犯罪行为，因此，恶意逃避债务或者协助恶意逃避债务尚不能认定是犯罪。但值得注意的是，按照我国《刑法》规定，如果债权人是银行，违法行为人通过恶意透支信用卡的方式进行诈骗，数额较大的，可构成信用卡诈骗罪。此外，虽然恶意逃避债务或者协助恶意逃避尚不构成犯罪，但是其并不意味着不需要承担民事、行政法律方面的责任。法律依据《中华人民共和国刑法》第二百六十六条
