释义	根据《刑法》的规定，行为人构成打击报复证人罪既遂的，处三年以下有期徒刑或者拘役；情节严重的，处三年以上七年以下有期徒刑。本罪的主体为一般主体，凡达到刑事责任年龄且具备刑事责任能力的自然人均可成为本罪主体。【法律依据】《中华人民共和国刑法》第三百零八条对证人进行打击报复的，处三年以下有期徒刑或者拘役；情节严重的，处三年以上七年以下有期徒刑。第十四条明知自己的行为会发生危害社会的结果，并且希望或者放任这种结果发生，因而构成犯罪的，是故意犯罪。故意犯罪，应当负刑事责任。
