释义	无效合同是已经成立的合同，是欠缺生效要件，不具有法律约束力的合同，不受国家法律保护。无效合同自始无效，合同一旦被确认无效，就产生溯及既往的效力，即自合同成立时起不具有法律的约束力，以后也不能转化为有效合同。合同无效后其双方当事人对违约条款的约定亦是无效的，也就不需要承担相应的违约责任了。【本文关联的相关法律依据】《民法典》第一百五十五条规定，无效的或者被撤销的民事法律行为自始没有法律约束力。（《民法典》生效时间为2021年1月1日）。
