释义	办理协议离婚的，只能到男女一方户口所在地的民政局办理，不能异地办理。但如果是到法院离婚，2人都离开户口地，被告在异地居住超过一年的，可以在异地法院办离婚。其他情况不能异地办理。法律依据:《婚姻登记条例》第十条，内地居民自愿离婚的，男女双方应当共同到一方当事人常住户口所在地的婚姻登记机关办理离婚登记。中国公民同外国人在中国内地自愿离婚的，内地居民同香港居民、澳门居民、台湾居民、华侨在中国内地自愿离婚的，男女双方应当共同到内地居民常住户口所在地的婚姻登记机关办理离婚登记。
