释义	法律分析：遗弃罪属于亲告罪。法律规定的遗弃罪属于亲告罪，对于此种类型的案件，由于一般情形下是不会导致社会混乱的，故此若是被遗弃的主体，并不想通过法律的途径维护自己的生命权益，此时法院也是不会干涉的，这是一般的亲告罪都具有的特征。遗弃行为必须达到情节恶劣程度的，才构成犯罪。法律依据：《中华人民共和国刑法》第二百六十一条对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
