释义	法律分析：违法建筑物的租赁合同是无效的。违章建筑是指“未经有关部门审查批准或采取欺骗手段骗取批准或虽经批准，但批准的内容违法而占地所建、扩建和改建的建筑物”。合同无效或被撤销后，因该合同取得的财产，应当予以返还。不能返还或者没有必要返还的，应当折价补偿。有过错的一方应当赔偿对方因此所受到的损失，双方都有过错的，应当各自承担相应的责任。法律依据：《中华人民共和国城市规划条例》第一百三十八条违法建设强拆的费用，将由违建者承担。
