释义	1、根据《中华人民共和国劳动合同法》第八十二条规定：用人单位自用工之日起超过一个月不满一年未与劳动者订立书面劳动合同的，应当向劳动者每月支付二倍的工资。2、如果用人单位已经依法跟劳动者协商订立劳动合同，但由于劳动者拒绝签，或双方就包括劳动报酬在内的劳动合同主要条款未能协商一致，均不应归责到用人单位。如果是劳动者拒绝同单位签订劳动合同的，用人单位应终止劳动关系，并支付经济补偿金，但此情况下无需支付二倍工资。
