释义	法律分析：承包工程一般是要求交一定数额的保证金。法律依据：《建设工程质量保证金管理办法》第四条缺陷责任期内，实行国库集中支付的政府投资项目，保证金的管理应按国库集中支付的有关规定执行。其他政府投资项目，保证金可以预留在财政部门或发包方。缺陷责任期内，如发包方被撤销，保证金随交付使用资产一并移交使用单位管理，由使用单位代行发包人职责。
