释义	法律分析：不算。如果判实刑，羁押期间折抵刑期，不算取保候审的时间。人民法院、人民检察院和公安机关对犯罪嫌疑人、被告人取保候审最长不得超过十二个月。在人民法院二审期间，犯罪嫌疑人羁押期已经超过一审法院所判处的有期徒刑的，也适用取保候审。法律依据：《中华人民共和国刑法》第四十七条有期徒刑的刑期，从判决执行之日起计算；判决执行以前先行羁押的，羁押一日折抵刑期一日。
