释义	元宵节不是国家法定节假日。目前我国的法定节假日有：元旦、春节、清明节、劳动节、端午节、中秋节、国庆节，并不包含元宵节，所以元宵节不是法定节假日。《劳动法》第四十条用人单位在下列节日期间应当依法安排劳动者休假：（一）元旦；（二）春节；（三）国际劳动节；（四）国庆节；（五）法律、法规规定的其他休假节日。第三十六条国家实行劳动者每日工作时间不超过八小时、平均每周工作时间不超过四十四小时的工时制度。
