法律分析：违法。根据我国相关法律规定，摩托车、电动车驾驶员和乘坐员是要按规定戴头盔的，如果不戴头盔将给予30元或者50元的罚款，之所以法规中有此条例，是根据我国摩托车发生事故率统计，80%的摩托车发生事故后就是因为没有戴头盔才产生严重的伤害，戴头盔是保护了脑袋的，不戴头盔发生事故的损伤率是戴头盔的2.5倍，说明戴头盔非常重要。摩托车：1、摩托车后座不得乘坐未满12周岁的未成年人、轻便摩托车不得载人，违反本规定处50元罚款。2、驾驶摩托车时未按规定佩戴安全头盔，处于50元罚款，并记2分。乘坐摩托车时不戴安全头盔，处于5元以上50元以下罚款。机动车：机动车行驶时，乘坐人员未按规定使用安全带，罚款50元，扣2分。
法律依据：《中华人民共和国道路交通安全法》
第八十九条 行人、乘车人、非机动车驾驶人违反道路交通安全法律、法规关于道路通行规定的，处警告或者五元以上五十元以下罚款；非机动车驾驶人拒绝接受罚款处罚的，可以扣留其非机动车。
第九十条 机动车驾驶人违反道路交通安全法律、法规关于道路通行规定的，处警告或者二十元以上二百元以下罚款。本法另有规定的，依照规定处罚。
