释义	法律分析：未签劳动合同辞职，也应当遵循签订了劳动合同的程序进行。因为劳动关系以事实劳动关系为准。因此需要和用人单位协商解除劳动合同，或者正式员工提前三十天，试用期员工提前三天书面通知用人单位解除劳动合同，即可辞职。法律依据：《中华人民共和国劳动合同法》第三十六条用人单位与劳动者协商一致，可以解除劳动合同。第三十七条劳动者提前三十日以书面形式通知用人单位，可以解除劳动合同。劳动者在试用期内提前三日通知用人单位，可以解除劳动合同。
