释义	法律分析：希望或者放任被害人死亡，不履行必要的扶养义务，致使被害人因缺乏生活照料而死亡，或者将生活不能自理的被害人带至荒山野岭等人迹罕至的场所扔弃，使被害人难以得到他人救助的，应当以故意杀人罪定罪处罚。父母遗弃弱智儿童致其死亡的行为涉嫌遗弃罪，还要承担刑事责任;遗弃致人死亡属于情节恶劣的行为，应当判处五年以下有期徒刑。法律依据：《中华人民共和国刑法》第二百六十一条对于年老、年幼、患病或者其他没有独立生活能力的人，负有扶养义务而拒绝扶养，情节恶劣的，处五年以下有期徒刑、拘役或者管制。
